Last updated: October 27, 2026

This is everything you agree to with the one tick before you pay. It is an agreement between you and Wizley ("we", "us", "our") for our website, platform and related services (the "Services"). If you do not agree, do not use the Services.

Terms of Service

Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the accuracy of the information you provide, for keeping your account credentials confidential, and for all activity under your account. Tell us promptly of any unauthorized use.

The Services

Wizley runs advertising for you in your area, from Wizley's own advertising accounts and its own offers. Your area is defined under How an area works. The leads those ads bring in are exclusive: each lead goes to one agent only, and is never sold twice. Where more than one agent shares an area, the leads in it are shared out by each agent's share of the area's ad budget, and of the agents whose turn it is, the one whose pin is closest to a lead gets it. We host the offer pages a lead lands on, provide a local texting number registered to you under your own carrier registration, which we file and manage for you, and follow up with your leads by text and email for you, using the information you supply. You are responsible for the accuracy and lawfulness of that information.

Wizley is an advertiser and a software company. It is not a real estate brokerage, does not hold a real estate licence, and does not buy, sell, list, rent or negotiate property for anyone. You are the real estate professional: a lead who answers one of our ads is introduced to you and your brokerage by name before you contact them, and the advice and services that follow are yours. What you pay depends only on your plan and your ad budget. We do not charge per lead, per appointment or per closing.

Your responsibilities

  • You will use the Services in compliance with all applicable laws and regulations, including those governing advertising, marketing, email, and telephone and text messaging.
  • Automated texts to your leads are sent from a number registered to you under your own carrier registration, which Wizley files and manages for you, and Wizley handles opt-outs from them. You are responsible for what you say yourself: any text, email or call you send or make to a lead or customer of your own accord, and for honoring an opt-out a lead gives you directly.
  • You will not use the Services to send unlawful, deceptive, harassing, or unsolicited communications, and you will comply with our Acceptable Use Policy.
  • You are responsible for your own content and for your relationships with your leads and customers.

Fees and payment

Paid Services are billed on a subscription basis through our payment provider. You authorize us to charge your payment method on a recurring basis until you cancel. Fees are non-refundable except where required by law or expressly stated.

Sales tax. All prices are plus applicable sales tax. Where a state requires us to collect sales tax on what you buy, it is added on top of the price when you are charged and shown as its own line on your receipt. Your billing address decides which state's tax applies.

Your rates are locked. For as long as you stay subscribed, we do not change the rates you pay us: your monthly plan price, which includes texting, calls, Ryze and video calls, and the percentage Wizley adds to your ad budget. What an advertising platform charges for results may change; the percentage we add does not. A change to our prices applies only to agents who start a plan after it takes effect.

Prices. Wizley Pro is $500 a month and Wizley Partner is $200 a month, with a processing and usage fee of 10 percent of your ad budget. There is no setup fee. If our prices ever change, agents who are already paying keep the price they pay; only new agents pay the new one.

No setup fee. When you sign up we charge your first month of the plan and 30 days of your ad budget with the processing and usage fee on it, in one payment. We charge no setup fee, now or when you come back: we pay for your texting registration and your number. Your monthly billing period runs from the day you pay. Your plan is month to month, with no term. If you close your account, whatever is left in your ad credit is refunded (see Ad budget and ad credit).

Setup should take 5 days. Setup is meant to take 5 days from your payment. For each day it takes longer, until your texting and ads are live, one thirtieth of your monthly plan price is credited on your next plan bill.

If you do not finish setup. If you start setup and never pay, we keep your answers for at least 90 days so you can pick up where you left off.

If you close your account and come back. There is no setup fee when you return. We hold your texting number for 30 days after your plan ends and release it after that. Once it has been released, you get a new number and a new texting approval from the carriers, which usually takes one to two weeks, and your place in the area's advertising is set up again. Restarting from a pause has no such wait: you are running again the same day.

Ad budget and ad credit

You set a daily ad budget, of at least the minimum shown for your area when you sign up. Your budget joins the campaign we run for your area, and is your share of it. When you sign up we charge your payment method in advance for 30 days of that budget plus the processing and usage fee on it (10 percent of it), and add the budget to your ad credit. Your ad credit goes down every day by your share of what your area's campaign spends. When about 5 days of budget are left, we notify you and then charge another 30 days of budget plus the fee, unless you have paused automatic refills. If a refill is declined, we try again each day for three days while your remaining ad credit is spent, and then pause your share of your area's campaign until you refill; you keep your place in the area.

The fee covers card processing and the extra texting, AI and video-call usage a bigger ad budget brings. Your plan covers the whole tool: ads management, your texting and AI system, the software and everyday usage. The fee is the only charge on top of your plan price and your ad budget, and it is one line on your receipt, with card processing included. The fee on what your ads spend is kept. The fee on the unspent part of your ad credit comes back with it when you leave.

The ad credit is a prepaid credit for Wizley's advertising service. Wizley buys the advertising in its own name, from its own advertising accounts. The ad credit can be used only for that service. It cannot be transferred to anyone, it has no cash value, and it is not a deposit, a bank balance, or money held for you. It is not held in trust, in escrow, or in a segregated account: it is recorded as a credit on your account, and your right to it is a contractual right against Wizley, not ownership of particular funds. Ad credit that has been spent is final. Ad credit that has not been spent is refunded only to the payment method it came from, and only when your account closes or when your ads never went live. We do not pay it out to you or to anyone else any other way.

If your budget never went live in your area, whether because the advertising platform refused it or because of a failure on our side, we refund the whole budget and the fee charged on it.

Automatic renewal and cancelling

Your plan renews automatically each month at your plan price (the price shown when you signed up, unless we tell you of a change as described below), and your ad credit refills automatically as described above, until you cancel. We tell you the price, the renewal date and what refills before you pay, we email you a confirmation that repeats these terms and says how to cancel, and we email you before a renewal. You can cancel your plan online at any time from Billing in your account, with no call or email: choose Close my account, type the word cancel and press the button. Pausing for $20 a month is shown in the same window as another choice of equal weight. Closing your account stops the next renewal and the next refill, and your plan runs to the end of the month you have already paid for; a charge that has already been made is handled as described in these Terms. We email you at least 7 and no more than 30 days before any change to your plan price or your processing and usage fee takes effect for you. The price and processing and usage fee you pay are not changed while you stay subscribed.

Fair use

Texting, calls, Ryze (our AI assistant) and video calls are included in your monthly plan price, with fair use. We do not charge per text, per call, per reply or per video minute. Fair use means ordinary use by one agent. If your use is far beyond that of a typical agent, we will tell you and talk with you about it. We do not bill you per text, call, reply or video minute, and we do not stop use automatically.

Third-party services

The Services rely on third-party providers, including hosting, email, telephony, calendar, advertising, and payment platforms. Your use of those services through Wizley may also be subject to their terms. We are not responsible for the acts or omissions of third-party providers.

Intellectual property

Wizley and its licensors own all rights in the Services, including the software, design, and content we provide. We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription. You retain ownership of the content and data you provide, and you grant us the rights necessary to operate the Services for you.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that they will produce any particular business result. Any figure we show you about leads, costs or results is an example, or the numbers from your own account; it is not a promise, a guarantee or an average of what other agents get. Wizley does not provide legal advice; the legal pages and compliance features are tools, and you remain responsible for your own compliance.

Limitation of liability

To the fullest extent permitted by law, Wizley will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability arising out of or relating to the Services will not exceed the amounts you paid us in the twelve months before the event giving rise to the claim.

Termination

Pausing your account. You can pause your account at any time from Billing. While it is paused you pay $20 a month in place of your plan fee, for as long as you want. A pause has no end date, and nothing closes or restarts on its own. The pause keeps your texting number and your texting approval, your contacts, your settings and the plan price you locked in, so you are running again the same day you restart. While your account is paused, your ads are off, nothing is drawn from your ad credit (which stays on your account), and nothing is texted or emailed to a lead from your account. That includes Ryze's messages and any text or email you type yourself. New leads and replies are still saved, and a lead who texts your number still reaches you. The pause price starts with your next invoice, not today, and the month you have already paid at your plan price is not refunded. You restart whenever you are ready: your plan comes back at the price you locked in, your ads and your ad budget do not start again on their own, and if you restart in a month in which the pause price has already been charged, the difference for the rest of that month is added to your next invoice. You can cancel at any time online, from Billing, including while your account is paused, as described under Automatic renewal and cancelling.

A pause that started before the paid pause existed keeps the terms it started under: your plan keeps billing, Ryze's texting stops except for replies you type yourself, and nothing closes, until you restart.

Wizley Partner plan (priced on Smart Agent Alliance membership). Where your price depends on your membership of Smart Agent Alliance, that price ends when the membership does. We will tell you, and as a protection for you, your account is automatically put on hold at $20 a month, and your place in your area is kept, until you choose to move to the Pro plan or cancel. The hold is the pause described above: you pay $20 a month in place of your plan fee, your ads stop, nothing is drawn from your ad credit (which stays on your account), and nothing is texted or emailed to a lead from your account. There is no free pause. We never move you to Pro, and never charge you more than you pay now, unless you choose it. You can restart at any time on the Pro plan, or close your account; if you close it and come back, there is no setup fee, as described under If you close your account and come back. Nothing closes or restarts on its own.

You may cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Services in a manner that creates risk or legal exposure. On termination, your right to use the Services ends; certain provisions survive, including those on fees owed, unpaid amounts, intellectual property, disclaimers, and limitation of liability.

If we stop providing the Services. If Wizley stops providing the Services altogether, we return your unspent ad budget, you keep your leads and your calendar, and you owe nothing further.

Governing law

These Terms are governed by the laws of the United States and of the State of California, where Wizley LLC is organized, without regard to conflict-of-laws rules. Any dispute will be resolved in the courts located there, unless otherwise required by applicable law.

Questions about these Terms can be sent to [email protected].

How an area works

  • Your area is the shared advertising area Wizley places you in when you drop your pin: a circle with a radius of about 15 miles that your pin sits inside. Your budget is your share of the ads Wizley runs in your area: one campaign, funded by every agent in it.
  • Leads are shared out by budget, so your share of the area's leads is your share of its budget. Each lead goes to one agent alone: of the agents whose turn it is by that share, the one whose pin is closest to the lead gets it. Nobody shares a lead. While you are the only agent in your area, every lead inside your area is yours.
  • Every area has a monthly spend limit: once it is reached, no new agent joins and no budget rises, and room that opens goes to one queue in the order asked. A budget cut takes effect next month.
  • Ad money already spent is final. Unspent ad credit is refunded to the payment method it came from if you leave, and leads already delivered stay yours. The ad credit is a prepaid credit for Wizley's advertising service: it cannot be transferred and has no cash value. If you dispute a payment to Wizley with your bank, your account is closed for good, your ads stop at once, and a new account cannot be opened with the same details.

Messaging Terms

These Messaging Terms govern the Wizley SMS program - text messages that Wizley sends to you, our customers and prospective customers, about your account and our Services. They are separate from the messaging terms for texts to a lead who answered one of our offers in an agent's area: a lead lands on Wizley's offer page for that area, and the agent is named after the form.

Program description

Wizley sends two kinds of text to your mobile number, both from Wizley's own toll-free number. A one-time sign-in or verification code is texted when you press Send code; that needs no separate agreement. Alert texts are sent only if you tick the separate, optional box that agrees to them, on the phone step of setup or in Settings, and verify the number: they tell you that something needs a look, such as an assistant reply waiting for your OK, a call booked or changed, a failed payment, an ad budget running out, a security or service notice, or a setup step to finish. You choose which of those reach you by text in Settings.

These are account and service texts only; Wizley does not send you marketing texts. Agreeing to alert texts is optional and is not a condition of buying anything: if you leave the box unticked you still receive the alerts you have chosen by phone notification and email, and they are always listed in the app.

Message frequency

Message frequency varies based on your account activity and the alerts you choose. You may receive recurring messages. Alerts are sent as events occur.

One-way alerts - replies are not read

Alert texts are one way. Replies to the number are not read by a person or an assistant, and no conversation takes place by text. A reply other than STOP, START or HELP gets one automatic message that points you to the Wizley app or to [email protected]. Support is by email or the support chat inside the app, never by text or by calling the number.

Message and data rates

Message and data rates may apply. Your mobile carrier's standard messaging and data charges will apply to each message sent or received, according to your plan. Wizley does not charge you for the text messages themselves.

How to opt out - reply STOP

You can cancel the SMS program at any time by replying STOP to any message. After you send STOP, we will send one confirmation message and then stop sending SMS messages to that number. You may continue to receive messages for a short period while your request is processed. To rejoin, reply START, or tick the box again in Settings.

How to get help - reply HELP

For help at any time, reply HELP to any message, or contact us at [email protected]. Replying HELP will return contact information for support: email, or the support chat in the app.

Supported carriers

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and is not guaranteed.

By ticking the box and verifying your number you confirm that the mobile number you provide is yours and that you are authorized to receive messages at it. If you change or deactivate your number, you agree to notify us. We handle the information collected through this program in accordance with our Privacy Policy.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding vendors acting on our behalf solely to deliver the messages you have consented to receive (such as our SMS delivery provider).

Questions about the SMS program can be sent to [email protected].

Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes conduct that is prohibited when using the Wizley platform and services (the "Services"). It is part of, and incorporated into, our Terms of Service. Because Wizley provisions sending identities, phone numbers, and messaging registrations on your behalf, your conduct affects the deliverability and standing of shared infrastructure. We enforce this AUP to protect all users.

Lawful use and consent

  • You must comply with all applicable laws and regulations, including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and carrier and industry messaging rules (including 10DLC and CTIA guidelines).
  • You must have a lawful basis and any required consent before contacting a person by email, text, or phone, and you must honor opt-out and unsubscribe requests promptly.
  • You must not text or auto-dial contacts who have not provided the required consent. On our platform, SMS is gated on stored consent by design; you must not attempt to circumvent that gate.

Prohibited content

You may not use the Services to create, send, or promote content that:

  • Is false, deceptive, or misleading, including false claims of scarcity or fabricated results;
  • Is unlawful, defamatory, harassing, abusive, or threatening;
  • Infringes intellectual property or privacy rights;
  • Contains malware, phishing, or attempts to acquire credentials or payment details under false pretenses;
  • Relates to categories restricted or prohibited by carriers and messaging authorities, including illegal substances, unlawful firearms, hate speech, and adult content.

Prohibited conduct

  • Sending unsolicited bulk or spam messages, or purchasing or using contact lists you are not authorized to message;
  • Impersonating any person or organization, or misrepresenting your identity or affiliation;
  • Supplying false legal-identity information for domain, sending, or messaging registration;
  • Attempting to gain unauthorized access to the Services, other accounts, or related systems, or interfering with their operation;
  • Reselling or providing the Services to third parties except as expressly permitted;
  • Using the Services to evade suppression lists, consent requirements, or a prior opt-out.

Messaging and deliverability standards

You must maintain reasonable list hygiene, promptly remove invalid and unsubscribed contacts, and keep complaint and bounce rates within accepted industry norms. Excessive complaints, spam-trap hits, or carrier violations may result in throttling, suspension, or termination to protect the platform and other users.

Enforcement

We may investigate suspected violations and take any action we consider appropriate, including removing content, throttling or disabling sending, suspending or terminating accounts, and reporting activity to carriers, providers, or authorities. We may act immediately and without prior notice where necessary to protect the Services or comply with legal or carrier requirements.

Reporting abuse

To report a violation of this AUP, contact [email protected].

Privacy Policy

This Policy applies to Wizley as a company. It does not govern the separate privacy notices our platform generates for each agent's own lead funnel, which are published under that agent's business and identity.

Information we collect

We collect the following categories of information:

  • Account and identity information you provide when you sign up or onboard, such as your name, email address, phone number, legal business name, business address, and professional license details.
  • Billing information processed through our payment provider. We do not store full card numbers on our own systems.
  • Platform data you and your leads generate while using the Services, including contacts, messages, appointments and pipeline activity.
  • Usage and device information such as IP address, browser type, pages viewed, and interactions, collected automatically as you use the Services.
  • Communications you send us, including support requests and email correspondence.
  • Device information for notifications if you turn on alerts: a push token that Apple or Google issues for your device, the name of the device, and the app version. It is used only to deliver your alerts.

How we use information

We use personal information to:

  • Provide, operate, maintain and improve the Services;
  • Provision your account, including domains, sending identities, phone numbers, and messaging registrations on your behalf;
  • Process payments and manage your subscription;
  • Communicate with you about your account, security, and service updates;
  • Provide support and respond to your requests;
  • Monitor, detect and prevent fraud, abuse and security incidents;
  • Comply with legal obligations and enforce our agreements.

How we share information

We do not sell your personal information. We share it only as needed to run the Services:

  • Service providers who process data on our behalf under contract - for example hosting, database, email delivery, telephony, calendar, and payment providers.
  • Registrars and carriers to the extent required to purchase domains and register messaging campaigns on your behalf, using the legal identity you supply.
  • Legal and safety disclosures when required by law, or to protect the rights, property or safety of Wizley, our users, or others.
  • Two AI providers: Anthropic, which processes lead conversations so our assistant can write replies, and TypeSafe, whose model reads each reply a lead sends back to tell whether they are asking us to stop, as described in the next two sections.
  • Apple and Google, which deliver notifications to your phone using the push token for your device.
  • Business transfers in connection with a merger, acquisition, or sale of assets, subject to this Policy.

Mobile information and text consent. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding vendors acting on our behalf solely to deliver the messages you have consented to receive (such as our SMS delivery provider).

The AI assistant

Wizley includes an assistant that answers and follows up with your leads for you. To write those messages it sends information to an outside AI provider, Anthropic. We ask your permission in the app before the assistant reads any of your leads, and we record your answer with the date and the version of this Policy.

  • What is sent: a lead's messages, their name, and the answers they gave on your form; the business details the assistant needs to write as you; and, when call notes are on (they are on by default once call recording is available, and you can turn them off in Settings), the call transcript used to write your notes. The recording and the full transcript are deleted as soon as the notes are written; only the notes (a summary, key facts, next steps, preferences and objections) are kept on the contact, until the contact or your account is deleted.
  • What it is used for: writing the reply or the notes, and nothing else. Under Anthropic's commercial terms, it does not use this information to train its models.
  • If you say no: the assistant stays off and never reads your leads. Your forms, texts and follow-up templates keep working. You can change your answer at any time in Settings, Account.

A second outside AI company, TypeSafe, reads what a lead writes back, for two purposes: to tell whether the message is a request to stop texting or emailing them, so that a stop is honoured even when it is not worded as one, and, where the agent has this turned on, to help the agent see which leads look ready to talk. It is sent the words of the message; for the agent's call list it is also sent the recent conversation and the agent's notes. We do not send it the contact record, so a lead's phone number and email address are not part of what it receives.

The Support chat. The Support chat in the app answers questions about how Wizleyworks. Before your first question we ask your permission, once, with one tap, to send it to an outside AI provider, Anthropic, and we record your answer with the date and the version of this Policy. What is sent: the conversation you type, and a short read of your own workspace (what setup still needs, how many leads are waiting, whether your ads are running, and this month's usage and plan facts). A lead's messages, notes, phone number and email address are not sent, and only a lead's first name can appear. It is used only to write the answer, and under Anthropic's commercial terms it does not use this information to train its models. If you say no, the chat stays closed and you can write to us instead.

People who contact an agent

When someone fills in a form on an agent's page or replies to an agent's text or email, the agent is the business that chose to collect that information, and Wizleyruns the system for them. The privacy notice linked from the agent's own page is the one that governs it. So that you can see what the system does, this is what it collects and keeps for a lead:

  • What the form collects: the name, email address and phone number the person gives, the answers they choose to add (such as the type of home, their timeline and financing), and their consent to texts and email, recorded with the exact page, wording and time. It also records the page and ad campaign the visit came from, the person's IP address and the browser and device they used, to measure which ads work and to stop abuse. When a browser sends the Global Privacy Control signal, the advertising click identifier is dropped from what we store.
  • What it keeps, and for how long: a lead and the conversation with them stay in the agent's workspace while the agent's account is active, and are erased with the account once the undo period in "Data retention" has passed. Records the law expects us to be able to produce are kept for eight years: the consent trail, the do-not-contact list, and every message that was sent or received.
  • When a lead is deleted: whether the agent deletes them or they ask us to, the lead is removed from the agent's account and from all follow-up, and is not contacted again unless they get in touch again. We keep message records for as long as the law requires, then delete them. Those messages are no longer linked to the person's details, the agent cannot see them, and they are used only if the law or a dispute needs them.
  • Who reads their messages: Anthropic writes the replies and TypeSafe reads each reply for a request to stop, as described above. A person can take over any conversation at any time.
  • What they can ask: a lead can reply STOP to a text, use the unsubscribe link in an email, or use Your Privacy Choices to ask us to tell them what we hold, correct it, or delete it. We record each request and answer within the time the law gives. We keep message records for as long as the law requires, then delete them.

Our phone apps

Our iPhone and Android apps show the same account as our website. If you turn on alerts, your device's push token is stored so Apple or Google can deliver them; it is deleted when you turn alerts off, sign out of the app, or delete your account. The apps do not track you across other companies' apps or websites, and we do not sell anything inside them. Payment happens on our website.

Data retention and deleting your account

We retain personal information for as long as your account is active and as needed to provide the Services. You can delete your account at any time in the app, under Settings, Account, or by following the steps on our account deletion page. When you do, your plan, texting, ads and bookings stop immediately and you are signed out. For 90 days you can ask us to restore the account; after that, your personal information and your leads are permanently erased. We keep only the records the law or card networks require, for as long as they require them, and use them for nothing else: payment and refund records (which include the name and email your payments were made under), the business identity your messages were sent under (your name, licence, brokerage and business address), your leads' texting consent and opt-out records, every message sent to or received from your leads (kept eight years), and a log of changes made to your account. These records still identify you. The eight-year rule for these records covers compliance records such as consent, opt-outs and messages; it does not cover call transcripts or recordings, which are not kept once your notes are written. We keep message records for as long as the law requires, then delete them.

Security

We use administrative, technical and physical safeguards designed to protect personal information, including tenant isolation at the database level so that one agent's data is not accessible to another. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your rights and choices

Depending on where you live, you may have the right to access, correct, delete, or port your personal information, and to object to or restrict certain processing. To exercise these rights, contact us at the address below. You may also unsubscribe from marketing emails using the link in any such message.

Your privacy choices. Wizley does not sell your personal information, and we do not share it with advertisers to show you ads across other companies' sites. If you want to tell us so anyway, use Your Privacy Choicesand we record your request. If your browser sends the Global Privacy Control signal, we honour it as that request on our pages and do not report your visit to an advertising platform.

Nevada residents. Nevada law lets you ask a website operator not to sell certain personal information collected online. We do not sell it. If you want to make that request anyway, email [email protected] or useYour Privacy Choices. We answer within 60 days, and may take up to 30 more if we need to.

Children's privacy

The Services are intended for businesses and are not directed to children under 16. We do not knowingly collect personal information from children.

International users

We operate in the United States, and information we process may be stored and processed there. By using the Services you understand your information may be transferred to and processed in the United States.
